{"id":38,"date":"2024-05-20T17:55:42","date_gmt":"2024-05-20T17:55:42","guid":{"rendered":"https:\/\/cocosova.com\/?page_id=38"},"modified":"2024-06-28T10:26:51","modified_gmt":"2024-06-28T10:26:51","slug":"regulamin-sklepu","status":"publish","type":"page","link":"https:\/\/cocosova.com\/en\/regulamin-sklepu\/","title":{"rendered":"Shop regulations"},"content":{"rendered":"<div data-elementor-type=\"wp-page\" data-elementor-id=\"38\" class=\"elementor elementor-38\" data-elementor-post-type=\"page\">\n\t\t\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-422e9a0 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"422e9a0\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-5c6410b\" data-id=\"5c6410b\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-0550b90 elementor-widget elementor-widget-text-editor\" data-id=\"0550b90\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>These Terms and Conditions set out the general terms, conditions and manner of sale by Renea Rados\u0142aw Styrylski, Rynek G\u0142\u00f3wny 3\/27, 41-042 Krak\u00f3w, Tax Identification Number (NIP): 6792831888, REGON: 121256697 via the Cocosova.com online store (hereinafter referred to as: \u201eOnline Store\u201d, \u201cSeller\u201d or \u201cAdministrator\u201d) and define the rules and conditions for the provision of free services by electronic means.<\/p><ul><li><strong>1 Definitions<\/strong><\/li><\/ul><ol><li><strong>Administrator<\/strong> \u2013 also referred to as the Seller.<\/li><li><strong>Working days <\/strong>\u2013 weekdays from Monday to Friday, excluding public holidays.<\/li><li><strong>Delivery<\/strong> \u2013 an activity consisting in the delivery of goods specified in the order to the Customer by the Seller, through the Supplier.<\/li><li><strong>Supplier<\/strong> \u2013 an entity with which the Seller cooperates in the delivery of goods:<\/li><\/ol><ul><li>1. courier company;<\/li><\/ul><ol><li><strong>Customer <\/strong>\u2013 an entity to which services may be provided electronically or with which a Sales Agreement may be concluded.<\/li><li><strong>Entrepreneur<\/strong> \u2013 a person conducting business or professional activity and performing legal actions directly related to their business or professional activity.<\/li><li><strong>Seller<\/strong> \u2013 Renea Rados\u0142aw Styrylski, Rynek G\u0142\u00f3wny 3\/27, 41-042 Krak\u00f3w, Tax Identification Number (NIP): 6792831888, National Business Registry Number (REGON): 121256697, who is also the owner of the Online Store.<\/li><li><strong>Goods <\/strong>\u2013 a product presented by the Seller via the online shop, which may be the subject of a Sales Agreement.<\/li><li><strong>Services <\/strong>\u2013 services provided by the Seller to Customers electronically within the meaning of the provisions of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended);<\/li><li><strong>Agreement<\/strong> \u2013 a distance sales agreement concluded between the Customer and the Seller on the terms specified in the Terms and Conditions.<\/li><li><strong>Order<\/strong> \u2013 a declaration of intent by the Customer, aimed directly at concluding a Sales Agreement, specifying in particular the type and quantity of Goods.<\/li><\/ol><ul><li><strong> 2 General provisions<\/strong><\/li><\/ul><ol><li>All rights to the online shop, including copyrights, intellectual property rights to its name, its internet domain, shop website, as well as to templates, forms, logos posted on the website (with the exception of logos and photos presented for the purpose of displaying goods, the copyrights to which belong to third parties) belong to the Seller, and their use may only take place in a manner specified and consistent with the Terms and Conditions and with the Seller's written consent.<\/li><\/ol><ul><li><strong> 3 Using the online shop<\/strong><\/li><\/ul><ol><li>The Seller shall endeavour to ensure that the online store can be used by users with all popular web browsers, operating systems, device types and Internet connection types. The minimum technical requirements for using the Store's Website are a web browser version of at least Internet Explorer 11 or Chrome 39 or FireFox 34 or Opera 26 or Safari 5 or newer, with Javascript enabled, accepting cookies and an Internet connection with a bandwidth of at least 256 kbit\/s.<\/li><li>In order to place an order in the Online Shop via the Shop Website or via e-mail, and in order to use the services available on the shop website, the Customer must have an active e-mail account.<\/li><li>It is prohibited for the Customer to provide unlawful content and to use the shop, its website or free services provided by the Seller in a manner contrary to the law, good manners or violating the personal rights of third parties.<\/li><li>The Seller declares that the public nature of the network and the use of services provided electronically may involve the risk of unauthorised persons obtaining and modifying Customer data, therefore Customers should use appropriate technical measures to minimise the above-mentioned risks. These include antivirus programmes and programmes that protect the identity of network users. The Seller never asks the Customer to provide their account password or other sensitive data.<\/li><li>It is not permissible to use the resources and functions of the shop for the purpose of conducting activities by the Customer that would violate the interests of the Seller.<\/li><\/ol><p><strong>\u00a0<\/strong><\/p><ul><li><strong> 4 Registration<\/strong><\/li><\/ul><ol><li>In order to create a Customer account, the Customer is required to register free of charge.<\/li><li>Registration is not required to place an order in the online shop.<\/li><li>In order to register, the Customer should complete the registration form provided by the Seller on the shop website and send the completed registration form electronically to the Seller by selecting the appropriate function in the registration form. During registration, the Customer sets an individual password.<\/li><li>When completing the registration form, the Customer has the opportunity to read the Terms and Conditions and accept their content by ticking the appropriate box on the form.<\/li><li>After submitting the completed registration form, the Customer receives confirmation of registration from the Seller at the e-mail address provided in the registration form. At this point, a contract for the provision of the \u201ecustomer account management\u201d service by electronic means is concluded, and the Customer gains access to the customer account and the ability to make changes to the data provided during registration.<\/li><\/ol><ul><li><strong> 5 Orders<\/strong><\/li><\/ul><ol><li>The information contained on the shop's website does not constitute an offer by the Seller within the meaning of the Civil Code, but merely an invitation to Customers to submit offers to conclude a Sales Agreement.<\/li><li>Customers can place orders in the shop via its website or by e-mail 24 hours a day, 7 days a week.<\/li><li>A customer placing an order via the shop website completes the order by selecting the Goods they are interested in. Goods are added to the order by selecting the \u201eADD TO BASKET\u201d command under the given Goods presented on the Shop Website. After completing the entire order and indicating the method of Delivery and form of payment in the \u201eBASKET\u201d, the Customer places the order by sending the order form to the Seller, selecting the \u201eBuy and pay\u201d button on the shop website. Each time before sending the order to the Seller, the Customer is informed about the total price for the selected Goods and Delivery, as well as about all additional costs that they are obliged to bear in connection with the Sales Agreement.<\/li><li>Placing an order constitutes the Customer's offer to the Seller to conclude a Contract for the sale of the Goods covered by the order.<\/li><li>After placing an order, the Seller sends a confirmation of its placement to the e-mail address provided by the Customer.<\/li><li>Next, after confirming the order, the Seller sends information about the acceptance of the order for processing to the e-mail address provided by the Customer. The information about the acceptance of the order for processing is the Seller's statement of acceptance of the offer referred to in \u00a74 section 6 above, and upon its receipt by the Customer, the Sales Agreement is concluded.<\/li><li>After concluding the Sales Agreement, the Seller shall confirm its terms and conditions to the Customer by sending them to the Customer's e-mail address or in writing to the address provided by the Customer during registration or when placing the order.<\/li><\/ol><ul><li><strong> 6 Payments<\/strong><\/li><\/ul><ol><li>The prices listed on the website next to a given Product are gross prices and do not include information about Delivery costs and any other costs that the Customer will be required to bear in connection with the Sales Agreement, about which the Customer will be informed when selecting the Delivery method and placing the order.<\/li><li>When ordering home delivery, the Customer may pay for the ordered goods in cash upon delivery or choose another form of payment:<\/li><\/ol><ul><li>1. PayU electronic payments<\/li><\/ul><ol><li>In the event of the Customer's failure to make payment on time, the Seller shall set an additional deadline for the Customer to make the payment and shall inform the Customer thereof.<\/li><li>If the second payment deadline passes, the Seller shall send the Customer a statement of withdrawal from the Sales Agreement pursuant to Article 491 of the Civil Code.<\/li><\/ol><ul><li><strong> 7 Delivery<\/strong><\/li><\/ul><ol><li>The Seller shall deliver within Poland.<\/li><li>For international shipping, please contact us at 508 501 008.<\/li><li>The Seller is obliged to deliver the Goods covered by the Sales Agreement free from defects.<\/li><li>The delivery and order fulfilment time is calculated in working days and is up to 14 days, which the Customer is informed of each time when placing an order.<\/li><li>The delivery and order fulfilment date indicated on the shop's website is calculated in working days.<\/li><\/ol><ol><li>The ordered Goods are delivered to the Customer via the Supplier to the address indicated in the order form.<\/li><li>On the day the Goods are dispatched to the Customer, information confirming the dispatch of the parcel by the Seller is sent to the Customer's e-mail address.<\/li><li>The Customer is obliged to inspect the delivered parcel in a timely manner and in a manner customary for parcels of this type. In the event of a loss or damage to the parcel, the Customer has the right to request that the Supplier's employee draw up an appropriate report.<\/li><li>At the Customer's request, the Seller shall enclose a receipt or VAT invoice covering the delivered Goods with the shipment being the subject of the Delivery.<\/li><li>If the Customer is not present at the address provided by them when placing the order as the Delivery address, the Supplier's employee will leave a delivery notice or attempt to contact them by telephone to arrange a date when the Customer will be present. If the ordered Goods are returned to the shop by the Supplier, the Seller will contact the Customer by email or telephone to re-arrange the date and cost of re-delivery with the Customer.<\/li><li>The customer should check the condition of the parcel upon receipt from the courier. If the packaging has visible external damage caused during transport, we recommend refusing to accept the parcel and then contacting us at the following telephone number: 508 501 008. However, after paying the cash on delivery amount or acknowledging receipt of the parcel, it is also possible to open the parcel, but in the presence of the courier, and if any discrepancies are found, you should ask the courier to draw up a damage report and at the same time keep this document for us.It is also best to contact us by telephone on 508 501 008.<\/li><\/ol><ul><li><strong> 8 Warranty<\/strong><\/li><\/ul><ol><li>The Seller shall ensure the Delivery of Goods free from physical and legal defects. The Seller shall be liable to the Customer if the Goods have a physical or legal defect (warranty).<\/li><li>If the Goods are defective, the Customer may:<\/li><\/ol><ul><li>1. submit a statement on price reduction or withdrawal from the Sales Agreement, unless the Seller immediately and without undue inconvenience to the Customer replaces the defective Goods with non-defective ones or removes the defect. This limitation shall not apply if the Goods have already been replaced or repaired by the Seller or if the Seller has failed to fulfil its obligation to replace the Goods with Goods free from defects or to remove the defects. Instead of the removal of the defect proposed by the Seller, the Customer may demand that the Goods be replaced with Goods free from defects or, instead of replacing the Goods, demand that the defect be removed, unless bringing the Goods into compliance with the contract in the manner chosen by the Customer is impossible or would involve excessive costs compared to the method proposed by the Seller. When assessing the excessive nature of the costs, the value of the Goods free from defects, the type and significance of the defect found shall be taken into account, as well as the inconvenience to which the Customer would be exposed by another method of satisfaction.<\/li><li>2. demand replacement of the defective Goods with non-defective ones or removal of the defect. The Seller is obliged to replace the defective Goods with non-defective ones or remove the defect within a reasonable time without undue inconvenience to the Customer. The Seller may refuse to satisfy the Customer's request if it is impossible to bring the defective Goods into compliance with the Sales Agreement in the manner chosen by the Customer or if, compared to the other possible method of bringing the Goods into compliance with the Sales Agreement, it would require excessive costs. The costs of repair or replacement shall be borne by the Seller.<\/li><\/ul><ol><li>A customer who exercises their rights under the warranty is obliged to deliver the defective item to the Seller's address.<\/li><li>The Seller shall be liable under the warranty if a physical defect is found within two years of the delivery of the Goods to the Customer. The right to claim for the removal of a defect or replacement of the Goods with defect-free Goods shall expire after one year. If the Customer requested replacement of the Goods with defect-free Goods or removal of the defect, the period for withdrawal from the Sales Agreement or submission of a statement on price reduction begins upon the ineffective expiry of the period for replacement of the Goods or removal of the defect.<\/li><li>Any complaints related to the Goods or the performance of the Sales Agreement may be submitted by the Customer in writing to the Seller's address or e-mail address: woda@cocosova.com.<\/li><li>Within 14 days of receiving a complaint, the Seller shall respond to the complaint regarding the Goods or the complaint related to the performance of the Sales Agreement submitted by the Customer.<\/li><li>The Customer may submit a complaint to the Seller in connection with the use of free services provided electronically by the Seller. The complaint may be submitted in electronic form and sent to the contact e-mail address.\u00a0 The complaint should include a description of the problem. The Seller shall consider the complaint and respond to the Customer without delay, but no later than within 14 days.<\/li><\/ol><ul><li><strong> 9 Withdrawal from the Sales Agreement<\/strong><\/li><\/ul><ol><li>The customer has the right to withdraw from the Sales Agreement within 14 days without giving any reason.<\/li><li>The deadline for withdrawing from the Agreement expires after 14 days from the date on which the Customer came into possession of the goods.<\/li><li>When withdrawing from the Agreement, you should inform the Seller by letter sent by post, fax or e-mail.<\/li><li>In the event of withdrawal from the Sales Agreement, it shall be deemed not to have been concluded.<\/li><li>In the event of withdrawal from the Sales Agreement, the Seller shall refund the Customer all payments received from them, including the costs of delivery of the Goods (except for additional costs resulting from the Customer's choice of a delivery method other than the cheapest standard delivery method offered by us), immediately, and in any case no later than 14 days from the date on which the decision to withdraw from the Agreement was communicated.<\/li><li>The refund will be made using the same payment methods as those used by the Customer in the original transaction, unless the Customer has expressly agreed to a different solution.<\/li><li>If the Customer exercising their right of withdrawal has chosen a method of delivery other than the cheapest standard delivery method offered by the Seller, the Seller shall not be obliged to reimburse the additional costs incurred by the Customer.<\/li><li>The seller has the right to withhold the refund until the item is received or until proof of its return is provided, whichever occurs first.<\/li><li>In the event of withdrawal, the Customer shall bear the direct costs of returning the goods, which may be sent back by regular post.<\/li><li>If, due to its nature, the Goods cannot be returned by regular post, the Seller shall inform the Customer about the costs of returning the goods on the shop's website.<\/li><li>The Customer shall be liable for any reduction in the value of the Goods resulting from their use in a manner exceeding that necessary to ascertain the nature, characteristics and functioning of the Goods.<\/li><\/ol><ul><li><strong> 10 Free services<\/strong><\/li><\/ul><ol><li>The Seller provides Customers with free services via electronic means: Contact form; Newsletter; Customer account management; Posting reviews.<\/li><li>Free services are provided 7 days a week, 24 hours a day.<\/li><li>The contact form consists of sending a message to the Seller using the form provided on the shop's website. You may opt out of this service at any time by ceasing to send enquiries to the Seller.<\/li><li>The newsletter is a service available to any Customer who enters their email address using the registration form provided by the Seller on the shop's website. After submitting the completed registration form, the Customer will immediately receive confirmation from the Seller by email to the email address provided in the registration form. At this point, a contract for the provision of the Newsletter service by electronic means is concluded.<\/li><li>The Newsletter service consists of the Seller sending electronic messages to an e-mail address containing information about new products or services offered by the Seller. The Newsletter is sent by the Seller to all Customers who have subscribed to it. Each Newsletter sent to Customers contains, in particular: information about the sender, a completed \u201esubject\u201d field specifying the content of the message, and information about the possibility and method of unsubscribing from the service. The Customer may unsubscribe from the newsletter at any time by clicking on the link provided in each e-mail sent as part of the service or by activating the appropriate field in their Account on the shop's website.<\/li><li>Maintaining a Customer account is possible after registration and consists in providing the Customer with a dedicated panel on the store's website, enabling the Customer to modify the data provided during registration, as well as to track the status of orders and the history of orders already completed. A Customer who has registered may request the deletion of their account, in which case, if a request for deletion is made, it may be deleted within 20 days of the request being made.<\/li><li>Posting opinions consists in the Seller enabling Customers who have an account on the shop's website to publish individual and subjective statements by the Customer concerning, in particular, the Goods.<\/li><li>The Seller is entitled to block access to the Customer's account and free services in the event of the Customer acting to the detriment of the Seller or other Customers, the Customer violating the law or the provisions of the Terms and Conditions, as well as when blocking access to the Customer's account and free services is justified for security reasons \u2013 in particular: if the Customer breaks the security of the store's website or engages in other hacking activities. Blocking access to the Customer's account and free services for the reasons mentioned above shall last for the period necessary to resolve the issue that is the basis for blocking access to the Customer's account and free services. The Seller shall notify the Customer of the blocking of access to the Customer's Account and free services by electronic means to the address provided by the Customer in the registration form.<\/li><\/ol><ul><li><strong> 11 Customer Obligations<\/strong><\/li><\/ul><ol><li>By posting content and making it available, the Customer voluntarily disseminates it. The posted content does not express the views of the Seller and should not be equated with its activities. The Seller is not a content provider, but only an entity that provides appropriate ICT resources for this purpose.<\/li><li>The customer declares that:<\/li><\/ol><ul><li>1. is entitled to exercise copyrights, industrial property rights and\/or related rights to, respectively, works, industrial property rights (e.g. trademarks) and\/or related rights that constitute the content;<\/li><li>2. the placement and disclosure of personal data, images and information concerning third parties within the framework of the services referred to in \u00a710 of the Regulations was carried out in a lawful and voluntary manner and with the consent of the persons concerned;<\/li><li>3. agrees to allow other Customers and the Seller to view the published content, and authorises the Seller to use it free of charge in accordance with the provisions of these Terms and Conditions;<\/li><li>4. agrees to the creation of derivative works within the meaning of the Act on Copyright and Related Rights.<\/li><\/ul><ol><li>The customer is not entitled to:<\/li><\/ol><ul><li>1. posting personal data of third parties as part of the use of the services referred to in \u00a710 of the Terms and Conditions, and disseminating the image of third parties without the legally required permission or consent of the third party;<\/li><li>2. posting advertising and\/or promotional content as part of the use of the services referred to in \u00a710 of the Terms and Conditions.<\/li><\/ul><ol><li>Customers are prohibited from posting content that could, in particular:<\/li><\/ol><ul><li>1. be posted in bad faith, e.g. with the intention of infringing the personal rights of third parties;<\/li><li>2. infringe any third party rights, including rights related to copyright and related rights, industrial property rights, trade secrets or confidentiality obligations;<\/li><li>3. be offensive or constitute a threat to other persons, contain language that violates good manners (e.g. through the use of profanity or terms commonly considered offensive);<\/li><li>4. be contrary to the Seller's interests;<\/li><li>5. otherwise violate the provisions of the Terms and Conditions, good manners, applicable law, social or moral norms.<\/li><\/ul><ol><li>Upon receiving notification, the Seller reserves the right to modify or remove content posted by Customers in the course of their use of the services, in particular with regard to content which, based on reports from third parties or relevant authorities, has been found to constitute a violation of these Terms and Conditions or applicable law. The Seller does not monitor the content posted on an ongoing basis.<\/li><li>The Customer agrees to the Seller's free use of the content posted by them on the shop's website.<\/li><\/ol><ul><li><strong> 12 Processing of personal data<\/strong><\/li><\/ul><ol><li>The administrator of personal data is the Seller, whose identification and contact details are specified in \u00a71 of these Terms and Conditions under the heading \u201eSeller\u201d.\u00a0<\/li><li>Personal data is processed in accordance with Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95\/46\/EC (hereinafter referred to as GDPR) and other generally applicable regulations.<\/li><li>The data obtained by the Administrator during the ordering process and conclusion of the sales contract is processed in connection with:<\/li><\/ol><ul><li>1. the necessity to perform contracts concluded by you with the Controller, as well as actions taken prior to the conclusion of the aforementioned contracts at your request (Article 6(1)(b) of the GDPR),<\/li><li>2. the necessity to fulfil a legal obligation incumbent on the Controller (Article 6(1)(c) of the GDPR).<\/li><\/ul><ol><li>When subscribing to the newsletter, personal data is processed on the basis of consent to the processing of personal data for marketing purposes in connection with sending commercial information in the form of a newsletter (Article 6(1)(a) of the GDPR).<\/li><li>The Customer's personal data may be processed in connection with the Administrator's legitimate interest in securing and pursuing claims (Article 6(1)(f) of the GDPR).<\/li><li>Providing personal data is voluntary, but necessary to place an order, conclude a sales contract and ensure its proper execution.<\/li><li>Depending on the selected delivery method and payment method, the Customer's personal data may be transferred to the selected carrier or intermediary performing shipments on behalf of the Administrator for the purpose of delivery, as well as to the entity handling electronic payments or card payments, entities providing hosting services and entities from the IT industry maintaining the online store.<\/li><li>Personal data is stored for the duration of the contract (newsletter subscription) and for the period necessary to secure or pursue any claims arising from the contract; after-sales customer service (complaint handling) or fulfilment of a legal obligation imposed on the Controller (resulting, for example, from accounting and tax regulations).<\/li><li>Personal data processed for marketing and other purposes not mentioned above will be processed until the previously given consent to their processing is withdrawn.<\/li><li>If the Administrator plans to further process personal data for a purpose other than that for which the personal data was collected, it is obliged to inform the Customer and provide all necessary information prior to such further processing.<\/li><li>The customer has the right to request the personal data controller to grant access to their personal data, rectify it, delete it or restrict its processing, the right to object to its processing, and the right to transfer it. The customer also has the right to lodge a complaint with a supervisory authority.<\/li><li>Information regarding the Administrator's obligation to protect the data of Buyers collected during purchases in the Shop in accordance with applicable regulations and in accordance with the highest standards of security and data protection is described in detail in the Privacy Policy (6. Personal Data Protection).<\/li><\/ol><ul><li><strong> 13 Final provisions<\/strong><\/li><\/ul><ol><li>The seller shall be liable for non-performance or improper performance of the Sales Agreement.<\/li><li>The content of these Terms and Conditions may be recorded by printing, saving on a data storage device or downloading at any time by the Customer.<\/li><li>In the event of a dispute arising from the concluded Sales Agreement, the parties shall endeavour to resolve the matter amicably. Polish law shall be the governing law for the resolution of any disputes.<\/li><li>The Seller informs the Customer about the possibility of using out-of-court methods of dealing with complaints and pursuing claims. The rules for accessing these procedures are available at the offices or on the websites of entities authorised to deal with disputes out of court. These may include, in particular, consumer ombudsmen or Provincial Inspectorates of Trade Inspection, a list of which is available on the website of the Office of Competition and Consumer Protection at http:\/\/www.uokik.gov.pl\/spory_konsumenckie.php.<\/li><li>The seller informs that an online platform for resolving disputes between consumers and businesses at EU level (ODR platform) is available at http:\/\/ec.europa.eu\/consumers\/odr\/.<\/li><li>The Seller reserves the right to amend these Terms and Conditions.<\/li><li>All orders accepted by the Seller for fulfilment before the date of entry into force of the new Terms and Conditions shall be fulfilled on the basis of the Terms and Conditions that were in force on the date of placing the order by the Customer. The amendment to the Terms and Conditions shall enter into force within 7 days of its publication on the Store's Website.
